Policy of providing translation services


  1. General provisions
    1. KMK undertakes to provide services according to the established market standards.
    2. KMK translates written documents on terms and conditions specified in the "Policy of providing translation services".
    3. Matters which are not regulated by the "Policy of providing translation services" shall be governed by the applicable and relevant legal provisions and universally accepted market standards.
    4. KMK offer is not addressed to private persons, and the Cooperation Rules do not apply to consumers within the meaning specified in the Act on competition and consumer protection of Feb 16th 2007 (Journal of Laws no. 50, item 331, with subsequent amendments) and the Act of April 23rd 1964 - Civil Code (Journal of Laws no. 16, item 93, with subsequent amendments)".

  2. Order placement
    1. KMK prepares the Offer for translation services specifying the price and service terms on the basis of documents provided by the Customer.
    2. KMK sets about to perform the given services as soon as the Customer signs and submits the applicable Offer.
    3. By signing the Offer, the Customer confirms that s/he understands and accepts the terms of "Policy of providing translation services".
    4. The Customer hereby declares that the text to be translated is free from any third party rights.

  3. Terms of providing translation services
    1. A standard translation page equals 1500 taps/characters (including all keyboard operations: letters, numbers, spaces, punctuation marks). The amount due is calculated on the basis of the number of characters in the translated text (in the target language), calculated with Word processor.
    2. The minimum accounting rate is one page of a translated text.
    3. The day of order acceptance and translation delivery, as well as Sundays and holidays are not to be included in the translation completion time.
    4. Translations which are to be completed on the day of providing the documents to be translated or on the following day are considered to be express translations.
    5. The translation completion terms runs from the day following the day the Customer submits a signed Offer to KMK.
    6. Translated texts can be collected at KMK office (ul. Powstańców Śląskich 1/45) on a designated day, after 2 p.m., unless it was otherwise agreed.
    7. The translated text is given to the Customer in printed (1 hardcopy) and electronic form.
    8. If the translation is delivered per fax, e-mail, or by courier post, KMK is responsible neither for possible delays due to force majeure nor for extended time of delivery by the courier post.
    9. KMK reserves the right to entrust the translation to translators chosen at its discretion (KMK employees, external translators).
    10. Anyone commissioned to complete translations signs confidentiality clause as to the content of translated documents as well as reference materials and information obtained.
    11. KMK has the right to undertake a translation on terms different from those specified in "Policy of providing translation services". Separate principles shall be set out in writing (agreement/offer).
    12. If the number of translated pages is different from the number specified in the Offer and accepted by the Customer, KMK has the right to change the translation completion date according to the translation mode selected.
    13. KMK reserves the right to reject an order (for reasonable and justifiable grounds)

  4. Terms of providing certified translation services
    1. Principles of providing certified translation services are regulated by the directive issued by the Ministry of Justice. One page of certified translation equals currently 1125 characters.
    2. The text of a certified translation can be collected at KMK office only (a single hardcopy). Additional copies are available at extra charge.
    3. Other terms of providing translation services are applicable also to certified translations.

  5. Other provisions
    1. In case of express mode or extra size orders placed by new customers, KMK reserves the right to establish additional, detailed payment terms (advance payment).
    2. These terms concern the so called "raw translation" which needs to be verified and edited prior to being used.
    3. The Customer undertakes to check the conformity of the translation with the materials provided by him/her prior to paying the amount due and to making the translation available to any third party. If the translated text is used in any way before the payment is executed, it shall be understood that the Customer accepts the target text without reservations.
    4. The customer acquires copyright of the translation upon payment of the total amount due based on the invoice issued by KMK.
    5. Possible customer complaints will be looked into without any additional charges provided the complaint is presented within two weeks from the translation collection. Lodging a complaint does not influence the payment deadline. Complaints submitted later will be charged according to appropriate rates (50 % of the rate for a given translation mode).
    6. Compensation for any losses suffered in relation to the order fulfilment cannot exceed the net remuneration due (VAT excluded).
    7. KMK is not liable for errors in express translations. If the Customer places an order for express translation, s/he accepts the risk of potential errors in this type of translations. Once errors are reported, KMK undertakes to correct them immediately.

  6. Payment and remuneration procedures
    1. The Customer undertakes to pay for the service rendered:
      - In case of the first order: on the day of translation collection (cash, same day bank transfer)
      - In case of subsequent orders: within 7 days from the receipt of the invoice by the Customer.
      - According to individual arrangements with KMK.
    2. Prices specified in "Pricelist of KMK services" are exclusive of VAT. Applicable VAT rate (23%) is to be added to the amount due in exchange for KMK services.
    3. If the customer cancels the order for any reason, s/he is obliged to pay the remuneration due for the actual work done.

  7. Changes of Cooperation Rules
    1. 1. KMK reserves the right to change the "Policy of providing written translations". The Customer will be informed of these changes via fax, e-mail or post. New terms will be also immediately put on the KMK website www.tlumaczenia-kmk.pl and www.tlumaczeniamedyczne.net.
    2. 2. Order placement or Offer acceptance by the Customer following the receipt of the changes introduced to the "Cooperation Rules" shall be deemed as the acceptance of new terms of cooperation by the customer.
